Applicable to commissioned development, to the AI-powered tools that result from it, to the free Local Anonymiser and to preliminary reports, offered by Capacity Consulting AS.
Last updated: November 2026. These Terms apply in the version published here at the time the relevant contract is entered into.
These Terms and Conditions ("Terms") apply to all services provided by Capacity Consulting AS ("Provider") in connection with the development, provision and operation of AI-powered tools. They apply both to the individual development of a tool as a fixed-price project ("Commissioned Development") and to the use of a tool already developed by the Provider that is offered directly to the customer ("Existing Product"). They also apply to the free Local Anonymiser and to preliminary reports; Section 11 contains the provisions specific to these offers and takes precedence for them. These Terms are addressed exclusively to business customers acting in the course of their trade or profession; they are not addressed to consumers.
(1) Commissioned Development: After receiving a description of the customer's problem, the Provider submits a fixed-price offer to the customer. Once payment has been received, the Provider delivers the result described in the offer within the stated timeframe (typically 5 business days) — depending on the case, a concept, a working prototype, or a finished tool.
(2) Existing Product: Alternatively, the Provider may offer the customer direct access to a tool it has already developed, which the customer may try out during a free trial period under Section 5.
(3) Where the result is a web-based tool hosted by the Provider, it is made available exclusively through password-protected online access; no source code or other program components are handed over (see Section 7).
(1) For a Commissioned Development, the contract for the one-off service described in the offer is formed once the customer pays, without reservation, the amount stated in the offer. By making that payment, the customer accepts these Terms in the version published at capcon.no/agb at the time of payment.
(2) For access to an Existing Product, the contract for the free trial period is formed once the Provider activates the customer's access.
(3) Should the customer wish to continue using a tool beyond the one-off service or the trial period, the parties enter into a separate usage agreement, which sets out the terms referred to in Section 6 in detail.
(1) For a Commissioned Development, the amount stated in the relevant fixed-price offer applies; payment is due before work begins.
(2) For continued use of a tool beyond the one-off service or the trial period, the terms set out in the relevant usage agreement apply.
(3) Unless agreed otherwise, invoices are due within 14 days of the invoice date, without deduction.
(4) In the event of late payment, the Provider is entitled, after a prior reminder and a reasonable grace period, to suspend access to a provided tool until the outstanding amount has been settled. Further statutory claims remain unaffected.
Where the Provider grants the customer access to an Existing Product, a free trial period of typically 30 days applies from activation of access. Within this period, the customer may end the trial informally (e.g. by email) at no cost. If the trial is not ended, it automatically continues into paid use under Section 6; the Provider will notify the customer of this separately, in good time before the trial ends. Details may be agreed differently on a case-by-case basis.
Where the customer continues to use a tool beyond the one-off service or the trial period, the term and termination provisions of the relevant usage agreement apply. Unless agreed otherwise, a minimum term of 12 months applies from the start of paid use; the agreement automatically renews for further periods of 12 months unless terminated in text form with reasonable notice before the end of the relevant term. Each party's right to terminate for good cause remains unaffected.
(1) Where a tool is provided, the Provider grants the customer a simple, non-transferable and non-sublicensable right to use it, within the agreed scope, via the provided online access.
(2) The customer does not receive access to the source code, the underlying prompt or evaluation logic, or any underlying data sets (e.g. domain-specific reference or contact databases). Any reproduction, decompilation, reverse engineering, disclosure to third parties, or other recreation outside the agreed purpose of use is prohibited.
(3) All rights in delivered concepts, prototypes and tools remain with the Provider, unless expressly agreed otherwise in writing.
Where the Provider processes personal data on the customer's behalf in the course of providing its services, the parties enter into a separate data processing agreement (DPA) in accordance with Art. 28 GDPR, which then forms part of the contractual relationship. How the Provider handles data of visitors and of persons who request a download or a report through capcon.no is described in the privacy notice.
(1) Output generated by AI systems (assessments, recommendations, suggestions or similar) constitutes an automated decision-support aid. It does not replace a qualified, certified, or legally required review by suitably qualified personnel, and does not constitute any assurance as to the accuracy, completeness, or currency of the output.
(2) The Provider's liability for ordinary negligence is excluded, except where a material contractual obligation is affected. The Provider is liable without limitation for intent, gross negligence, and damages resulting from injury to life, body or health, as well as under any mandatory statutory provisions.
The Provider may amend these Terms with effect for the future. Unless expressly agreed otherwise, the version published here at the time the relevant contract was formed continues to apply to contracts already concluded.
(1) Local Anonymiser. The Local Anonymiser is free software under the GNU General Public License, version 3 (GPL-3.0). The customer may use, study, copy and change it under that licence. It is provided as it is, without warranty of any kind, to the extent the law allows. The tool runs in the customer's browser on the customer's own computer and replaces names and other identifying details with placeholders. It can miss details. The customer checks the anonymised result before sending it and removes whatever is still identifiable.
(2) What the customer may send. The customer sends the Provider only documents that the customer has anonymised and is allowed to pass on, and is responsible for this. The customer does not send personal data, trade secrets of third parties or documents that the customer must keep confidential, unless the customer is entitled to share them in anonymised form. This applies to the case description as well. The Local Anonymiser asks the customer to confirm this before it sends files. If identifiable data reaches the Provider, the customer informs the Provider at info@capcon.no and the Provider removes it.
(3) Preliminary reports. A preliminary report is a first assessment of the anonymised documents and the short description that the customer sends. The report is generated by an AI model; a consultant at the Provider checks its quality before it is delivered, for every report. The Provider aims to deliver it one to two business days after it has received the customer's data. This is a target, not a guarantee. The report is preliminary. It is not legal advice, not a coverage opinion, not a loss adjuster's or expert's report and not a basis for settling or declining a claim. It rests only on what the customer has sent, and may contain errors or gaps. The customer checks the report against the original documents and obtains professional advice before relying on it for a decision with legal or financial effect. The customer may use the report for its own purposes and share it within its organisation and with its advisers.
(4) Free first report. Each company can receive one free preliminary report. The Provider may limit the number of free reports. In return, the customer promises to give honest feedback on the report. The Provider uses the feedback to improve its service and does not publish it with the name of the customer or its company without the customer's consent. The code that the customer receives for the free report is valid for a limited time and a limited number of uploads and cannot be passed on. The free report is not a trial under Section 5 and never turns into paid use. The contract for the free report is formed when the Provider confirms the request by email and sends the code.
(5) Further reports. For further reports the Provider first sends a fixed-price proposal. The contract for a paid report is formed when the customer accepts the proposal in writing. Section 4 applies to payment.
(6) Free review before an order. Before the customer places an order, the Provider may agree with the customer to look at documents that the customer has anonymised and sends with a code from the Provider, in order to say what a project can achieve. This review is free and without obligation for both sides. The Provider decides how detailed its answer is. A contract for commissioned development is formed only when the customer accepts the Provider's written proposal in writing; Section 4 applies to payment. Subsection (2) applies to what the customer may send.
(7) Request and contact. The customer requests a report with its work email address and confirms the request by a link sent to that address. Before each request the customer confirms that the Provider may contact the customer about it. The customer may ask the Provider at any time to delete its data.
(8) Liability. Section 9 applies. For a paid report, liability for ordinary negligence where a material contractual obligation is affected is limited to the fee paid for that report, to the extent the law allows. For the Local Anonymiser, the free report and the free review, the Provider is liable only for intent and gross negligence, and under mandatory statutory provisions. The Provider is not liable for decisions that the customer or others take on the basis of a preliminary report.
(9) Availability. The Provider may change, pause or stop the free offers at any time.
(1) Should any individual provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected.
(2) These Terms are governed by the laws of Norway, subject to any mandatory consumer-protection or other protective provisions applicable at the customer's place of business. To the extent legally permissible, the venue for any disputes is Oslo, Norway.
Questions about these Terms are welcome at info@capcon.no.
